ORAL ORDER

Heard Sri. Somashekara K.M., learned counsel for the petitioner.

2. The present petition is filed impugning the order dated 04.07.2026, wherein respondent No.2(b) in FDP No.24/2019 has been permitted to be transposed as petitioner No.2.

3. Learned counsel appearing for the petitioner submits that the FDP, without granting sufficient opportunity to oppose the application in I.A. No.8, has permitted the transposition of respondent No.2(b) as petitioner No.2. It is submitted that petitioner Nos.1 and 2 are acting in collusion, which would prejudice the rights of the other respondents.

4. Considered the submissions made by learned counsel appearing for the petitioner and perused the writ petition papers.

5. The affidavit accompanying the application states that respondent No.2(b) and petitioner No.1 are the children of Gowramma and B.S. Kempananjappa. It is further stated that

HC-KAR

both petitioner No.1 and respondent No.2(b) are claiming rights through their mother, late Gowramma. It is also stated that there is no conflict of interest between petitioner No.1 and respondent No.2(b).

6. Though learned counsel appearing for the petitioner though vehemently contended that petitioner No.1 and respondent No.2(b) are acting in collusion to the prejudice of the rights of the other parties, the same has not been demonstrated. Petitioner No.1-B.K. Lokesh and respondent No.2(b) are brother and sister, claiming right and share in the suit schedule property through their mother-Smt.Gowramma and father-B.S.Kempananjappa. In such circumstances, this Court finds that no prejudice would be caused to the interest of the petitioner in transposing respondent No.2(b) as petitioner No.2 in FDP No.24/2019. The petition is devoid of merit and is accordingly rejected. Sd/- (K. V. ARAVIND) JUDGE
