ORAL JUDGMENT

(PER: HON'BLE MR. JUSTICE D K SINGH)

The present Intra Court Appeal has been filed impugning the judgment and order dated 27.08.2026 passed by the Writ Court in W.P.No.26309/2023 filed by respondents No.4 to 6 impugning the order dated 31.07.2023 passed in R.A.No.413/2021 by the Assistant Commissioner and the order dated 07.11.2023 in Revision Petition No.179/2023 passed by the Deputy Commissioner.

2. The said orders came to be passed on behest of the appellant herein, who is claiming title in respect of the land in question on the basis of the sale deed allegedly executed in his favour in the year 1960. The application for change of mutation entry on behalf of the appellant was made in the year 2023 i.e., after 53 years from the date of alleged sale deed, whereas the respondent – father’s name continued in the revenue record in all these years. Therefore, the learned Single Judge considering the

HC-KAR

fact has held that as the suit is pending, the revenue entries in favour of the appellant cannot be changed at this belated stage unless and until the rights of the parties over the land in question are finally settled in appropriate procedure.

3. We find no error in the judgment passed by the learned single Judge which warrants us to interfere with. Therefore, we dismiss this appeal having no merit and substance.

4. All applications stand disposed of.

5. The mutation entry in favour of respondents No.4 to 7 shall be subject to the outcome of the appropriate civil proceedings.
