ORAL ORDER

(PER: HON'BLE MR. JUSTICE S.G.PANDIT)

Heard learned counsel Sri.Vikram Phadke for the petitioner and learned CGC Smt.Sadhana.S.Desai for respondent Nos.1 to 3.

2. Learned counsel Sri.Vikram Phadke would submit that the above writ petition was filed questioning the interim order dated 18.12.2025 in OA No.602/2025 passed by the Central Administrative Tribunal at Bengaluru, rejecting the prayer of the petitioner to stay notice of termination dated 26.11.2025 (Annexure-A8). Further learned counsel would submit that this Court by order dated 23.12.2025 stayed Annexure-A8 notice of termination dated 26.11.2025. However, the interim order made an observation that the petitioner not to claim any salary till he clears the examination.

3. Learned counsel Sri.Vikram Phadke would submit that subsequent to the interim order passed by this

HC-KAR

Court, the petitioner passed all required examination and on he passing the required departmental examination, the respondent by Office Order dated 29.06.2026 withdrew the notice of termination dated 26.11.2025. Thus he would submit that nothing would survive for consideration in the present writ petition and he seeks permission to withdraw the writ petition. Further, he submits that since in terms of this Court's order, he has already passed the required departmental examination, he may be permitted to claim salary.

4. Learned CGC Smt.Sadhana.S would not dispute the above fact. However, she submits that it would take some time to settle the benefits to the petitioner to which he would be entitled.

5. Be that as it may, the submission of the learned counsel for the petitioner is placed on record.

6. Accordingly, the writ petition is disposed of.

HC-KAR

7. Since the petitioner has passed all the departmental examination, it is open for the petitioner to claim salary for the period during which he has worked and it is open for the respondents to consider the request of the petitioner and pass appropriate orders, in accordance with law.

Pending IA's if any, stands disposed of. Sd/- (S.G.PANDIT) JUDGE Sd/- (DR.CHILLAKUR SUMALATHA) JUDGE NS List No.: 1 Sl No.: 15
