ORAL JUDGMENT

(PER: HON'BLE MR. JUSTICE D K SINGH)

We have taken up this appeal in the revised call. There is no representation on behalf of the appellant to press this appeal either in the first call or in the revised call. This Court on 04.06.2024 passed the following order: "Learned counsel Sri. Shekarappa for the appellant is present before the Court physically. He seeks short accommodation to furnish requisite process fee for issuance of notice against respondent even though the matter is slated for second time. However, keeping view the submission made by the learned counsel a week's time is granted to furnish requisite process fee, if the process fee is not paid, then the matter would be viewed seriously. If process fee is paid, Registry is directed to issue process against the respondent. List this matter next week in the usual course."

2. Till date requisite steps have not been taken for issuance of notice. In view thereof, we have no option but to dismiss the appeal for non-prosecution.

HC-KAR

3. Accordingly, the appeal is dismissed for non- prosecution.
