ORAL ORDER

(PER: HON'BLE MR. JUSTICE D K SINGH)

The present contempt petition has been filed alleging willful disobedience and non-compliance of the order dated 01.04.2024 passed by the writ Court in W.P.No.3210/2024 (BDA). The operative portion of the said order would read as under:- "3. In view of the above, it would be appropriate to direct the respondents to consider the representations made by the petitioner for complying with the judgment and decree passed in O.S.No.3694/2002 and as confirmed in R.F.A.No.1037/2016 within a period of two months from the date of receipt of a copy of this order."

2. The complainant has obtained a decree in O.S.No.3694/2002 filed by him. The regular first appeal filed against the said judgment and decree by the Bangalore Development Authority has been dismissed for non-prosecution on 10.04.2023. Instead of executing the decree, the

HC-KAR

complainant/petitioner has filed the writ petition, no mandamus can be issued.

3. Learned counsel for the complainant submits that after the notice in the contempt petition has been issued, the BDA has issued an allotment letter.

4. In view thereof, no contempt is made out. We deem it appropriate to close the contempt proceedings. Accordingly, the contempt proceedings are dropped and the notice stands discharged.

5. However, if the complainant is not satisfied with the allotment letter issued by the Bangalore Development Authority, he may approach the appropriate forum, if so advised.
