ORAL ORDER

(PER: HON'BLE MR. JUSTICE JAYANT BANERJI)

This petition is filed with a delay of 47 days. I.A.No.1/2026 is filed seeking condonation of delay.

HC-KAR

2. The contempt petition is filed alleging willful disobedience of the judgment and decree dated 27.08.2013, passed in O.S.No.349/2006, by the Principal Senior Civil Judge & JMFC, Srirangapatna, Mandya, by executing an illegal sale deed dated 09.01.2025, in favour of third party in January’2025.

3. It is the own contention of the learned counsel for the complainant that the sale deed was executed after the decree for specific performance dated 27.08.2013 passed in the original suit, stood satisfied in execution proceedings.

4. Admittedly, it is after the date of satisfaction of the decree by executing a sale deed by the court in favour of the complainant, that the alleged illegal sale deed was executed by the accused in favour of a third party.

5. That being the case, in our considered opinion, no contempt is made out qua the judgment and decree

HC-KAR

dated 27.08.2013, passed in the original suit. This petition is misconceived and is accordingly consigned.

I.A. No.1/2026 is rejected.
