ORAL ORDER

(PER: HON'BLE MR. JUSTICE S.G.PANDIT)

This review petition is filed under Order XLVII Rule 1 read with Section 114 of CPC by the petitioner who was writ petitioner in WP No.7559/2025, praying to review order dated 27.03.2025 whereunder the petitioner's challenge to the order of Tribunal to quash the order of penalty of compulsory retirement on the proved charge of demand and acceptance of bribe of Rs.4,000/- for effective corrections in the record of rights, was rejected.

HC-KAR

2. Heard learned counsel Sri.T.Narayanaswamy for learned counsel Sri.B.G.Fayaz Sab for the petitioner and perused the entire review petition papers.

3. The present review is filed by a different counsel who had not appeared before the Bench which passed the order on 27.03.2025 in W.P.No.7559/2025 rejecting the writ petition.

4. Be that as it may, Sri.T.Naryanaswamy, learned counsel urged that while passing the impugned order, the Bench failed to take note of the judgment in criminal case whereunder the petitioner was acquitted of the charges based on the same incident on which the departmental enquiry was initiated and proceeded. Along with the above, learned counsel for the petitioner had also canvassed several other grounds.

6. The grounds urged by the learned counsel for the petitioner would not amount to an error apparent on the face of the record. It is to be remembered while

HC-KAR

considering the review petition, this Court would not sit as the Appellate Court to examine and to re-hear the writ petition itself on merits.

7. On going through the review petition papers as well as on hearing the learned counsel for the petitioner, we do not find any error apparent on the face of the record in the order under review.

Accordingly, review petition stands rejected.

In view of the rejection of the petition, I.A.No.1/2026 for condonation of delay of 346 days in filing the review petition would not survive for consideration. Sd/- (S.G.PANDIT) JUDGE Sd/- (DR.CHILLAKUR SUMALATHA) JUDGE DS CT:TSM List No.: 1 Sl No.: 6
