ORAL JUDGMENT

Learned counsel for the appellant has filed a memo for withdrawal, in which it is stated as under: "MEMO FOR WITHDRAWAL The appellant above named respectfully submits as follows:

1. The above matter was initially filed as a criminal Petition. During scrutiny, an office objection was raised that, in view of the provisions of the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989, the appropriate remedy would be by way of a Criminal Appeal.

2. Pursuant to the conversation order, the said Criminal Petition has been converted and numbered as Criminal Appeal No.1473/2026.

HC-KAR

3. It is respectfully submitted that the Appellant has also preferred Criminal Appeal No.1289/2026 before this Hon'ble Court in respect of the same matter.

4. Hence, the Appellant does not wish to press the present Criminal Appeal No.1473/2026 and seeks permission of this Hon'ble Court to withdraw the same as not pressed. WHEREFORE, the Appellant most respectfully prays that this Hon'ble Court may be pleased to permit the Appellant to withdraw the present Criminal Appeal No.1473/2026 as not pressed and dismiss the same as withdrawn, in the interest of justice and equity."

2. Memo is placed on record.

3. In view of memo of withdrawal, the appellant is permitted to withdraw this appeal. Accordingly, appeal is dismissed as withdrawn.
