HC-KAR

3. The accusation made against the accused persons is that they indulged in the commission of offences punishable under Sections 464, 465, 466, 467, 468, 470, 471, 472, 420 and 167 read with Section 34 of the IPC, as well as Section 192-A of the Karnataka Land Revenue Act, by making use of forged documents for the sale of the property to the tune of Rs.45,62,00,000/-.

4. The Trial Court, while considering the application for discharge, has taken note of the aforesaid accusation and the same is also challenged before the Revisional Court, which has also considered the material on record. When such serious accusation is made, the question of entertaining the petition under Section 482 of the Cr.P.C. for quashing of the proceedings does not arise, or otherwise it amounts to interfering with the order of the Trial Court and conducting a mini trial. The law is settled to that effect that there cannot be a mini trial at the time of consideration of accusation and all the grounds that

HC-KAR

have been urged could be raised during the course of trial. Hence, no ground is made out to invoke Section 482 of Cr.P.C., and accordingly, the petition is dismissed.
