The undersigned counsel for the Appellant submits that the captioned Appeal is preferred against the order of the Ld. JMFC IV Court, Mangaluru and in view of the Judgment passed by the Hon'ble Supreme Court in in the case of CELESTIUM FINANCIAL v. A GNANASEKARAN ETC. reported in 2025 SCC ONLINE SC 1320, the captioned Appeal needs to be transferred before the appropriate District Court, therefore the memo. The counsel for the Appellant prays that this Hon'ble court may kindly be pleased to take this memo on record and transfer the captioned Appeal in the interest of justice and equity."

In view of Memo and keeping in mind the judgment of the Hon'ble Supreme Court in the case of CELESTIUM FINANCIAL v. A GNANASEKARAN ETC. reported in 2025 SCC ONLINE SC 1320, this appeal stands disposed of

transferring the case to concerned District Court for disposal in accordance with law.
