ORAL ORDER

The petitioner is before the Court, seeking the following prayer: "I. call for records, if necessary. II. To Quash the FIR & complaint in Cr No.96/2026 registered by HSR layout Police Station registered in 3rd Addl CMM court, Bengaluru city now transferred to CID Bangalore for the offences punishable under section under section offences punishable under Section 316(2), 316(5), 318(4), 319(2), 3(5) of Bharathiya Nyaya Sanhita 2023 pending before the 3rd Addl. CMM Court at Bangalore in the interest of justice and equity. III. Grant such other order or orders, which this Hon'ble Court may be pleased to pass, in the circumstances of the case, to stall the abuse of process of Court, in the interest of justice."

2. Heard Sri. M.R. Nanjunda Gowda, learned counsel appearing for the petitioner, Smt. Rashmi Patel, learned HCGP appearing for respondent No.1 and have perused the material on record.

3. The allegation against the petitioner is at the time when he was functioning as an Inspector of Motor Vehicles had indiscriminately registered vehicles from different states and

HC-KAR

also fitness certificate is granted indiscriminately, which has caused loss to the exchequer.

4. Learned HCGP however would submit that it is a matter of investigation in the least.

5. In the light of the said circumstance, I deem it appropriate to direct the petitioner to face investigation and re-approach this Court once the final report is filed and the final report would go against him.

With the aforesaid observations, the petition stands disposed.

All contentions remain open. Sd/- (M.NAGAPRASANNA) JUDGE
