ORAL ORDER

Aggrieved by the order dated 19.06.2026 passed in I.A.No.31 in O.S.No.8311/2006 by the XVII Additional City Civil and Sessions Judge, Bangalore, the petitioner/plaintiff is before this Court.

2. The petitioner herein has instituted the suit in O.S. No. 8311/2006 seeking partition and separate possession. In the suit, defendant No. 5 has filed I.A. No. 31 under Order XXVI Rule 1 read with Section 151 of the CPC to issue a Commission for examination, as he is unable to attend the Court due to ill health. That application was allowed by the trial Court.

3. While allowing the application, the trial Court observed that defendant No.5 is suffering from severe osteoporosis and Knee orthotic condition, and that he had placed the medical certificate before the trial Court. In the medical certificate, the orthopaedic surgeon noted that defendant No. 5 cannot stand for long periods and has difficulty walking moderate distances due to illness. The trial Court observed that when the parties pleaded before the Court, their

HC-KAR

inability to appear in person and their request for an order appointing a court commissioner to record his evidence at his residence could not be rejected. Because of a party’s ill health or any other inconvenience on the part of the parties, the delivery of justice should not be impeded, and the application was allowed.

4. Learned counsel appearing for the petitioners/ plaintiffs submits that defendant No. 5 has appeared before the Criminal Court and attends all the family functions. In those circumstances, the trial court ought not to have allowed the application for the appointment of a commissioner. It is submitted that if the evidence is recorded before the court, the demeanour of witnesses and other aspects can be examined by the Court.

5. Learned counsel appearing for respondent No. 10/ defendant No.5 submits that he cannot dispute the fact that he has appeared before the Court, as it is a criminal matter, and that he went to the Court only for appearance. However, cross- examination and other proceedings take a lot of time. As the doctor has clearly given a medical certificate stating his health

reasons, the trial Court has rightly considered it and passed the order.

6. Having heard the learned counsel on either side, perused the entire material on record. There is no dispute that defendant No. 5 is about 77 years old. As per the medical certificate, defendant No.5 is suffering from severe osteoporosis and cannot stand for long hours. The apprehension stated by the petitioner cannot be appreciated. The court has rightly considered and held that, given the ill health of the party, the commissioner was appointed, and this court is not inclined to interfere with the order passed by the trial Court. Hence, this Court is passing the following order:

ORDER

i. Accordingly, the writ petition is dismissed.

ii. All I.As. in this petition shall stand closed.
