ORAL ORDER
The petitioner is before the Court seeking the following prayers:
"(a) Quash the FIR and complaint initiated against the petitioner in Crime No.0086/2025, Narasimharaja P.S., on the file of the Hon'ble III Addl. Civil Judge (Jr Dn) & JMFC Court, JLB Road, Mysore for alleged offences punishable under Sections 318(4), 336(3) and 340 of BNS.
(b) Pass any other order or direction as this Hon'ble Court deems fit in the circumstances of the case to meet the ends of justice."
2. Heard Sri. Rajesh A., learned counsel appearing for the petitioner; Smt. Deepthi Alva, learned High Court
HC-KAR
Government Pleader appearing for respondent No.1 and Sri. Mallikarjuna T, learned counsel appearing for respondent No.2.
3. The position of the petitioner is rather strange, she is not the daughter, but claims to have all the property of the deceased. The petitioner enters the house of the deceased 15 years ago, as a caretaker. Today claims that she is the foster daughter and the allegation is that she holds all the properties in her name and the funds, which were sent by the complainant to the caretaker to take care of the father. Care has been unduly taken, is the allegation.
4. In the teeth of the said allegation, which has the shades of forgery and cheating, investigation in the least is a must. Therefore, permitting investigation, the petitioner is reserved liberty to knock at the doors of this Court in the event, the final report is filed and the final report would go against the petitioner.
5. With the aforesaid observation, the petition stands disposed.
HC-KAR
6. All the contentions remain open.
Ordered accordingly.
