ORAL ORDER

Heard Sri. Ajay Kadkol T., learned counsel appearing for the petitioner, Smt. Deepthi Alva, learned HCGP appearing for respondent No.1, Sri. Prereet Jain B., learned counsel appearing for respondent No.2 and have perused the material on record.

2. The petitioner is before this Court, seeking the following prayer: "(a) A Writ or direction of appropriate nature or pass an order quashing the First Information Report in Crime No.60/2021 registered at the CEN Crime

HC-KAR

Police Station, Mysuru City as against the petitioner for offences which are made penal under Sections 420 & 406 of the Indian Penal Code arranging the petitioner as the first accused, as well as the complaint filed on the basis of which the crime is registered as against the petitioner and which is produced at ANNEXURE -"A". And/Or

(b) grant any other relief/s as this Hon'ble Court may deem fit, in the ends of justice."

3. On a perusal at the complaint, this Court is of the opinion that investigation in the least is a must. Investigation has been conducted against all other accused and there has been an interim order operating in the case at hand. In the light of the interim order subsisting in the subject petition, the charge sheet or final report is not filed against the petitioner. Therefore, the petitioner shall now participate in the investigation and the Investigating Officer shall conclude the investigation within an outer limit of ten (1)0 weeks from the date of receipt of the copy of the order and file the final report before the concerned Court.

HC-KAR

4. In the event the final report would go against the petitioner, the petitioner is at liberty to approach this Court all over again.

5. All the contentions would remain open to be considered thereon.

6. In the light of the interim order subsisting for the last 4 years and the direction being issued for completion of the investigation and filing of the final report within ten (10) weeks, I deem it appropriate to direct the concerned Investigating Officer not to take any coercive steps against the petitioner, subject to his participation / cooperation with the investigation.

With the aforesaid observations, the petition stands disposed. Sd/- (M.NAGAPRASANNA) JUDGE
