ORAL JUDGMENT
(PER: HON'BLE MR. VIBHU BAKHRU, CHIEF JUSTICE)
1. The appellant has filed the present appeal impugning an order dated 04.02.2026 passed by the learned Commercial Court and II Additional District and Sessions Judge, Mysuru, in Com. O.S.No. 212/2024, in dismissing the application filed under Order VII Rule 11 of the Code of Civil Procedure, 1908.
2. Concededly, the present appeal is not maintainable as the order is not an appealable order. The learned counsel for the appellant seeks to withdraw the present appeal and further prays that the court fee be refunded.

3. In view of the above, the present appeal is dismissed as withdrawn.
4. The registry is directed to refund the court fee as per the Rules.
5. Pending application stands disposed of.
