ORAL ORDER

Learned counsel appearing for the petitioner files a memo seeking withdrawal of the petition with liberty to challenge charge sheet. The memo so filed reads as follows:

"MEMO FOR WITHDRAWAL OF CRIMINAL PETTION WITH LIBERTY TO FILE FRESH PETITION

The Petitioner respectfully submits as follows:

The present petition under Section 528 of BNSS, 2023 was filed seeking quashing of FIR and complaint in Crime No.8/2026 registered by DCRE Eastern Range Police Station, Davangere. During pendency, investigation has concluded and charge-sheet has been filed before the Hon'ble Special Court under SC and ST Act, that additional district and sessions Judge at Davanagere. In view of the development, the prayer for quashing FIR has become infructuous. The Petitioner intends to challenge the charge-sheet and consequential proceedings by filing a fresh petition, therefore liberty may kindly be granted to the petitioner and to render justice."

HC-KAR

Liberty so sought is granted.

In terms of memo, the petition is disposed as withdrawn.
