ORDER

OR

DIRECTION

DIRECTING RESPONDENT NOS.1 TO 3 TO CONSIDER AND TAKE A REASONED DECISION, WITHIN A TIME-BOUND PERIOD TO BE FIXED BY THIS HON'BLE COURT, ON ADOPTION AND IMPLEMENTATION IN THE STATE OF KARNATAKA OF A TENANCY FRAMEWORK ON THE LINES OF THE MODEL TENANCY ACT, 2021, EITHER BY FRESH LEGISLATION OR BY SUITABLE AMENDMENT OF THE EXISTING LAW AND ETC.

THIS PETITION, COMING ON FOR PRELIMINARY HEARING, THIS DAY, ORDER WAS MADE THEREIN AS UNDER:

HC-KAR

CORAM: HON'BLE MR. VIBHU BAKHRU, CHIEF JUSTICE and HON'BLE MRS. JUSTICE K.S. HEMALEKHA

ORAL ORDER

(PER: HON'BLE MR. VIBHU BAKHRU, CHIEF JUSTICE)

1. The petitioner has filed the present petition as a public interest litigation seeking several prayers. Essentially, the petitioner seeks that a legislation be framed on the lines of the Model Tenancy Act, 2021, which has been circulated to various States and Union Territories.

2. The petitioner's grievance is that a comprehensive tenancy enactment has not been framed and the Karnataka Rent Act, 1999 is not a substitute for the comprehensive tenancy reforms.

3. We are not persuaded to accept that any directions are required to be issued to the State Government to frame any legislation. The writ petition is, accordingly, dismissed.
