ORAL ORDER

(PER: HON'BLE MR. VIBHU BAKHRU, CHIEF JUSTICE)

1. The complainant has filed the present complaint alleging willful disobedience of the order dated 09.01.2025 passed by the learned II Additional Principal Judge, Family Court, Bengaluru, in M.C.No.122/2025 [impugned order].

2. The learned Family Court had passed the said order taking into account the memorandum of settlement arrived at between the parties in mediation. In terms of the said settlement agreement, the parties had agreed to dissolve their marriage, without any further

claims against each other. The accused had also agreed to cooperate with the complainant for closure/quashment of C.C.No.497/2017 filed by the accused against the complainant and his family members, under Sections 498A and 494 read with Section 34 of IPC, which is pending before the IV Additional District Judge, Danapur, Patna (Bihar).

3. The Complainant's case is that the terms of the said settlement have been breached. However, we are not persuaded to accept that the same warrants initiation of proceedings under the Contempt of Courts Act, 1971. The complaint is, accordingly, closed.

4. This order will not preclude the complainant from availing of the substantive remedies available in law.
