ORAL ORDER

The petitioner is before the Court seeking the following prayer: "WHEREFORE, the petitioner most respectfully prays that this Hon'ble court be pleased to Issue a Writ of Mandamus directing the Learned Judicial Magistrate First Class (Traffic Court - III), Bengaluru City, to dispose of I.A.No.01 of 2023 filed by the Petitioner under Section 23(2) of the Protection of Women from Domestic Violence Act, 2005, in Criminal Miscellaneous No.136 of 2023, within a stipulated period of one week, vide ANNEXURE - C, in the interest of justice and equity."

2. The petitioner is said to have instituted proceedings before the concerned Court invoking the provisions of Domestic Violence Act.

HC-KAR

3. The learned counsel appearing for the petitioner submits that despite the passage of three years, the concerned Court has not concluded the proceedings. Therefore, is before the Court seeking expeditious disposal of the same.

4. In the light of the prayer being innocuous and the fact that the domestic violence proceedings cannot hang on for more than six months in terms of the statute, I deem it appropriate to direct the concerned Court to conclude the proceedings within an outer limit of three months from the date of receipt of the copy of the order, if not earlier.

5. With the aforesaid observation, the petition stands disposed.

Ordered accordingly.
