ORAL JUDGMENT

(PER: HON'BLE MR. JUSTICE D K SINGH)

In view of the affidavit dated 04.08.2026 filed on behalf of the State, in which, it has been stated in paragraph 3 to 6, as under: "3. I state that, the above matter came up before this Hon'ble Court on 16.07.2026. On that day, the Hon'ble Court directed the authorities to file an Affidavit in respect of repeal of Sections 79A, 798, 79C of the Karnataka Land Reforms Act, 1961.

4. I state that, the aforementioned Sections 79A, 798, 79C of the Karnataka Land Reforms Act, 1961 has been omitted vide Karnataka Gazette bearing No.56/2020 published on 30.12.2020. Clause 13 of the said Amendment Act, states as under:

Notwithstanding such repeal, anything done or any action taken under the principal Act, as amended by the said Ordinance, shall be deemed to have been done or taken under principal Act, as amended by this Act.

5. I state that, however, Clause 12 states as under:

Sub-Clause-2 clearly indicates that any pending cases before any Court, Tribunal or any competent authority under the provisions of principal Act shall stand abated from the date of such passing an Amendment Act.

6. I state that, insofar as those lands, which have converted to non-agricultural purposes prior to the repeal of Sections 79A, 798, 79C of the Karnataka

HC-KAR

Land Reforms Act, 1961, they have lost the character of an agricultural land and therefore, the said provisions would not apply."

2. We are of the view that, nothing survives in this appeal and the same stands disposed of.

3. In view of the dismissal of the appeal, pending I.As, if any, do not survive for consideration and the same stand disposed of.
