ORAL JUDGMENT

(PER: HON'BLE MR. JUSTICE D K SINGH) These intra-court appeals are filed impugning the order dated 06.04.2026 passed by the learned Single Judge of this Court in W.P.No.43740/2016 (LB-BMP) connected with W.P.No.2490/2026 (LB-BMP).

2. The petitioner/appellant had filed both the writ petitions. The petitioner in fact claimed the prayer or the relief of injunction and declaration in respect of 12 guntas

HC-KAR

of land in O.S.No.5888/1993, the said suit was dismissed. The same was appealed against in RFA No.299/2008, which also got dismissed, and the SLP NO.2914/2023 preferred against the said RFA, the Supreme Court also dismissed the Special Leave Petition.

3. Allegedly the petitioner has encroached upon the road margins and civic amenity sites. When the petitioner has been found that he is not having any right, title and interest in respect of the land measuring 12 guntas, which is reserved for the Civil amenity sites and the road margins, he cannot come to this Writ Court again to say that for road margins, the survey should be conducted in his presence.

4. Petitioner, having encroached upon the public land, cannot approach this court and seek equitable remedy under Articles 226 of the Constitution of India. The petitioner who allegedly has encroached the road margins

HC-KAR

and civic amenity sites has no right to challenge the survey and the removal of the encroachment.

5. We do not find any substance in the writ appeal, and the same stands dismissed. Sd/- (D K SINGH) JUDGE Sd/- (T.M.NADAF) JUDGE HR List No.: 1 Sl No.: 8
