ORAL ORDER

The petitioner is before this Court seeking the following prayers: "WHEREFORE, the Petitioners above named pray that this Hon'ble Court be pleased to quash the FIR in Crime No. 140/2026 of Kumbalagudu Police Station for the offences punishable U/s 318(4), 319(2), 336(2), 336(3), 329(3), 340(2), and 351(2) of the BNS pending on the file of the 2nd ADDITIONAL CHIEF JUDICIAL MAGISTRATE (ACJM), Bengaluru Rural, Bengaluru, and to grant such other relief/s as this Hon'ble court deems fit, in the interest of justice."

2. Heard the learned Senior Counsel Sri.D.R.Ravishankar appearing for the petitioner qua several other accused arising out of the same crime, wherein this Court

HC-KAR

has permitted investigation. Heard Sri.B.N.Jagadeesha, learned SPP-I appearing for the respondent-State and have perused the material on record.

3. The petitioner-a Second Division Assistant is before the Court seeking quashment of the said crime. The learned Senior Counsel appearing for the petitioner submits that there is no act that would become an allegation for the offences that are laid against this petitioner in particular, as he is a public servant who has no role to play whatsoever in the entire episode.

4. In the light of the petition filed by every other accused being turned down where investigation into the matter was permitted, I deem it appropriate to permit investigation in the case at hand, as well.

5. The learned Senior Counsel would submit that the petitioner has not secured bail. In that light, I deem it appropriate to dispose the subject petition, directing the petitioner to participate in the investigation and reserving

HC-KAR

liberty to him to reproach this Court, once the final report is filed against him.

6. The respondent-State is directed not to take any coercive steps against the petitioner for a period of two weeks to enable the petitioner to secure bail at the hands of the concerned Court. The interim protection of coercive steps not to be taken, is granted, only for two weeks. The concerned Court shall endeavor to conclude the bail application, if so filed, within the said period.

With the aforesaid observations, the petition stands disposed.
