HC-KAR
Addl. CMM Court, Bengaluru City, for the offences under Sections 115(2), 118(1) read with Section 3(5) of the BNS 2023.
2. Heard Sri.Sirajuddin Ahmed, learned counsel appearing for the petitioners, Sri.K.Nageshwarappa, learned HCGP appearing for respondent No.1, Sri.Naveed Ahmed Z, learned counsel appearing for respondent No.2 and have perused the material on record.
3. During the pendency of the proceedings, the parties to the lis have settled the dispute among themselves and have filed a Joint Memo along with Joint Affidavit which reads as follows: The said Joint Memo reads as follows: “1. The Petitioners have filed the present Criminal Petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, seeking to quash the proceedings in Crime No. 0114/2026 registered by the Siddapura Police Station, Bengaluru, pending before the Court of 2nd Addl. CMM Court, Nrupatunga Road, Bangalore City, registered for the alleged offences under Section 115(2), 118(1), R/W 3(5) of the BHARATIYA NYAYA SANΗΙΤΑ, 2023.

wishers, and family members, the parties have amicably resolved all their differences and have decided to put an end to the dispute.
3. The Respondent No. 2, being the original complainant, has no objection whatsoever to the quashing of the FIR in Crime No. 114/2026 and all proceedings emanating therefrom against the Petitioners.
4. It is submitted that the settlement has been arrived at voluntarily, without any force, fraud, coercion, or undue influence from any quarter. The parties have decided to restore peace and harmony in their neighborhood.
5. The offences alleged are not of a heinous nature affecting society at large and are essentially private in character. In view of the amicable settlement, the continuation of the criminal proceedings would be a futile exercise and an abuse of the process of the Court, causing undue hardship to both parties.
