ORAL ORDER

(PER: HON'BLE MR. JUSTICE D K SINGH)

The present writ petition has been filed by the petitioner impugning the order dated 09.07.2025 passed by the Lokpal of India, whereby liberty has been granted to respondent No.5 to proceed against the complainant, if he is so advised, under the provisions of Section 46(3) of the Lokpal and Lokayuktas Act, 2013 (for brevity 'the Act') before the Court of competent jurisdiction.

HC-KAR

2. The petitioner, who is working as a Senior Manager in Middle Management Grade Scale - III was posted in Central Office of the Corporation Bank, the Central Office - annexed to the Corporation Bank at Mangalore, filed a complaint before the Lokpal, which was registered as complaint No.214/2024. The said complaint after considering the report of the Chief Vigilance Officer of the Union Bank of India, was disposed of by the Lokpal vide order dated 11.03.2025

3. The action taken report on the order dated 11.03.2025 was submitted to the Lokpal, and the Lokpal vide order dated 11.06.2025 having considered the action taken report observed that no further action was warranted in the matter and the case file was consigned to the records.

4. The respondent No. 5 thereafter, filed an application seeking permission to invoke Section 46 of the Act on 09.06.2025 before the Lokayukta. The Lokayukta vide impugned order dated 09.07.2025 passed in complaint No.214/2024 considering the provisions of Section 46, disposed off the application of respondent No.5, that respondent No.5 would be at liberty to proceed against the complainant under

HC-KAR

the provisions of Section 26(3) of Act. As the corruption charges were not found proved, it was only mere irregularity in the system of the Bank, the complaint filed by the petitioner was closed and on the application filed by respondent No.5 liberty under Section 46(3) has been granted.

5. We find no error in the impugned order passed by the Lokpal, which is why the present petition is dismissed.

6. Pending interlocutory applications, if any stand disposed of. Sd/- (D K SINGH) JUDGE
