ORAL ORDER

Heard Sri. Sudharshan L., learned counsel appearing for the petitioners, Smt. Deepthi Alva, learned High Court Government Pleader appearing for respondent No.1, Smt. Janavi R., learned counsel appearing for respondent No.2 and have perused the material on record.

2. During the pendency of the proceedings, the parties to the lis have settled the dispute among themselves and have filed a compounding application along with affidavits. The compounding application reads as follows:

"APPLICATION UNDER SECTION 320(2) r/w 482 OF THE CODE OF THE CRIMINAL PROCEDURE

1. That the petitioners are arrayed as accused no.1 and 2 in C.C. no. 306/2025 for the offences punishable u/s 341, 504, 323, 506, 354, 34 of IPC and pending on the file of IV AddI. CJ and JMFC at Hassan and on the file of Hassan Extension Police station which was registered in Crime no. 31/2024.

2. That being aggrieved by the Chargesheet filed against the petitioners for the offences punishable u/s 341, 504, 323, 506, 354, 34 of IPC registered in C.C. no. 306/2025 pending on the file of IV AddI. CJ and JMFC at Hassan, the petitioners have

HC-KAR

approached this Hon'ble court to quash the Chargesheet filed against them.

3. That during the pendency of the above matter before this Hon'ble court and Trial Court, the respondent no.2 and 3 were chief examined as PW1 and PW2 and then upon intervention of well- wishers and friends, the dispute between the petitioner and the respondents 2 and 3 are amicably resolved with cordial terms. And therefore, the respondents 2 and 3 have no objection to quash the proceedings against the petitioners by withdrawing the allegations levelled against them.

4. That the respondents 2 and 3 are not interested in prosecuting the petitioners in view of the compromise with the petitioners and further have felt that continuation of criminal proceedings against them would not serve any fruitful purpose and it would only be an abuse of process of law.

5. That the settlement arrived between the petitioners and the respondents 2 and 3 is out of free will, there is no coercion or force, fraud or any undue influence.

WHEREFORE, the petitioners and respondents most humbly pray that this Hon'ble court may be pleased to permit them to compound the offences in the above matter and to quash the Chargesheet filed against the petitioners for the offences punishable u/s 341, 504, 323, 506, 354, 34 of IPC registered in C.C. no. 306/2025 pending on the file of IV Addl. CJ and JMFC at Hassan.

3. In the light of application for compounding being filed along with the affidavits and offences not being against the State, I deem it appropriate to accept the compounding

HC-KAR

application and terminate the proceedings against these petitioners in the subject petition.

4. For the aforesaid reasons, the following:

ORDER

(i) Criminal petition is disposed.

(ii) Proceedings in C.C.No.306/2025 pending before the IV Additional CJ and JMFC at Hassan, stands quashed qua the petitioners.
