ORAL ORDER

(PER: HON'BLE MR. JUSTICE D K SINGH)

The present intra-Court appeal has been filed impugning the order dated 25.01.2025 passed by the Writ Court in W.P.No.15511/2018 filed by the respondent, for a

HC-KAR

direction to consider the representation filed by him dated 27.02.2018 and pay interest on the leave encashment amount in accordance with the law.

2. The appellant has admitted that Leave encashment amount of Rs.1,82,000/- was due and payable as per the Communication dated 17.11.2017. In view of the aforesaid admission, the Writ court directed the appellant to pay the leave encashment amount of Rs.1,82,000/- along with interest @ 6% per annum.

3. In compliance of the said order, the appellant has paid Rs.1,82,000/- to the respondent on 18.04.2026. However, interest has not been paid. We therefore, find no reason to interfere with the impugned order passed by the Writ Court. Accordingly, the Writ Appeal is dismissed. However, we extend time for making payment of interest on the Leave Encashment amount of Rs.1,82,000/- @ 6% per annum from 17.11.2017 till 18.04.2026, within a period of six weeks from today.

HC-KAR

4. As we have extended the time for making payment of interest as directed by the Writ Court, the Contempt Petition does not survive for consideration. Accordingly, it is closed. However, if the payment is not made, the Contempt Petition shall stand revived.
