ORAL JUDGMENT

The learned counsel for the appellant files a memo. The contents of the said memo reads as follows: "Honourable Court may be pleased to treat this appeal as writ petition in the interest of justice as the appellant has already filed W.P. in W.P.No.16127/2023 wherein the Court observed that, appeal under Cr.P.C. is the proper jurisdiction and dismissed the writ petition. Hence, this memo." On going through the averments of the said memo, it appears that, as against the order passed by this court in W.P.No.16127/2023, the appeal does not lie. Hence, the learned counsel for the appellant is directed to take appropriate steps to challenge the said order before the appropriate forum having jurisdiction. For statistical purpose, the criminal appeal stands disposed of.
