Present: None for the applicant bank.
This matter is taken up by this Tribunal through Video Conferencing at DRT, Allahabad.
2. In the present matter, MA No. 45/2021 has been filed on behalf of applicant bank praying therein to permit the applicant to withdraw the present RC No. 482/2018.
3. In compliance of order dated 08.04.2021 of this Tribunal, Ld. Recovery Officer has filed the Report in the present case.
4. I have gone through the Report of Ld. Recovery Officer. It is stated in the report that the CH bank filed affidavit of satisfaction on 11.02.2020 but the same does not reflect the OTS amount.
5. Though, applicant bank has not disclosed OTS amount, however, in the present MA it is stated that the defendants have paid all overdue amount of the bank. Hence, applicant bank does not want to continue the recovery proceedings against the CDs.
5. In the present matter, applicant bank has also filed statement of account (Annexure-'B') along with the MA which shows that the account has already been closed. In the light of above, this MA is **Sd/-**
hereby allowed. Now the RC is hereby dismissed as withdrawn in view of settlement arrived between the parties.
6. A copy of this order be sent to Ld. Recovery Officer for information and necessary action.
File be consigned to records.
Registry of DRT, Allahabad is directed to send the scanned copy of this order to DRT-III, Delhi for uploading the same on website of DRT-III, Delhi.
