This matter is taken up by this Tribunal through Video Conferencing at DRT, Allahabad.
2. In the present matter, MA No. 47/2021 has been filed on behalf of applicant bank praying therein to permit the applicant to withdraw the present RC No. 441/2018.
3. In compliance of order dated 27.07.2021 of this Tribunal, Ld. Recovery Officer has filed the Report in the present case.
4. I have gone through the Report of Ld. Recovery Officer. It is stated in the report that the CH bank filed affidavit of satisfaction on 10.02.2020 and it is stated that during the OA proceedings CH bank received sum of Rs. 11,07,148.70 and thereafter, CDs entered into settlement with CH bank and received Rs. 71,11,853 and the CH bank recovered Rs. 82,19,001.70/- from the defendants. It is further stated in the report that the CH bank wants to close the RC as satisfied.
5. In the light of above, this MA is hereby allowed. Now the RC is hereby dismissed as withdrawn in view of settlement arrived between the parties.
