ORDER

This petition under Article 226 of Constitution of India has been filed seeking the following reliefs:

(i) To issue an appropriate writ or order in regard to quashing of impugned order dated 13/06/2022 (Annexure P-10) passed by respondent No.3 in the interest of justice.

(ii) That this Hon'ble Court may kindly be pleased to issue an appropriate writ or order directing respondent to permit the petitioner for continuous working in the establishment.

(iii) That this Hon'ble Court may kindly be pleased to issue an order directing the respondents to consider the petitioner's representation in the interest of justice.

(iv) Any other relief which this Hon'ble Court may deem just and proper in the facts and circumstances of the case may kindly issued in favour of Petitioner.

2. It is not out of place of mention here that petitioner had earlier filed WP No.4733/2023 seeking the similar reliefs which was dismissed by coordinate Bench of this Court by order dated 28.02.2023 with liberty to petitioner to pursue his other remedy as available to him as per law.

3. It appears that without availing such remedy petitioner has again approached this Court for the reliefs as mentioned above.

4. In the light of reliefs claimed by petitioner, this Court is of considered opinion that this petition is barred by principle of res judicata.

5. Accordingly, petition fails and is hereby dismissed.
