This appeal coming on for admission this day, the court passed the following:
ORDER
Counsel for the appellant submits that the appellant in this case has been convicted for offence under Section 20 (b) (ii) (B) of the NDPS Act and sentenced to undergo RI for 8 months with fine of Rs.2,000/-. It is further contended that as the appellant was in custody since the date of the impugned judgment dated 01.02.2022, hence, he has already served the jail sentence imposed on him. Thus, this appeal has rendered infructuous and, therefore, he prays for withdrawal of the appeal. In view of the above, the appeal is dismissed as withdrawn.
