This application is filed by the auction purchaser in S.A. No. 594/2023 for withdrawal of the present appeal on the ground that the matter has been settled between the respondents.
It is submitted by the Ld. Counsel for the petitioner/appellant that petitioner/appellant has received the sale consideration from the respondent no.3 bank in compliance of the order dated 27.06.2025 passed by the Ld. DRT and, therefore, this withdrawal application.
Ld. Counsel for respondents present and they have no objection for withdrawal of the appeal.
In view of the reasons stated in the application and the matter is settled between the parties, this withdrawal application is allowed. The appellant is permitted to withdraw the appeal.
Accordingly, the appeal is dismissed as withdrawn, being settled out of court.
File be consigned to record room.
