**Vivek Gupta vs. IDBI Bank Ltd.**

**25/03/2026**

Mr. Sanjeev Bhandari along with Mr. Anand Aggarwal, Ld. Counsels appeared for applicant through VC.

Mr. Parthiv J Mehta, Ld. Counsel appeared for respondent bank through VC.

This matter has been taken up through Video Conferencing.

This application is filed by the applicant seeking direction to the Ld. Presiding Officer, DRT-II, Delhi to decide M.A. No. 35/2026 expeditiously.

Ld. Counsel for the petitioner/applicant submitted that the Recovery Officer attached to DRT-II, Delhi has no jurisdiction to decide the territorial jurisdiction and to decide the sale of the property concerned in the recovery proceedings. Therefore, he moved M.A. No. 35/2026 to transfer R.C. No. 18/2023 from Recovery Officer attached to DRT-II, Delhi to DRT having territorial jurisdiction over the property situated at Panipat, Haryana. Ld. Presiding Officer on 13.03.2026 ordered notice to respondents returnable by 20.04.2026. Meanwhile, the Recovery Officer is trying to pass further orders in recovery proceedings.

Ld. Counsel for the respondent bank appeared and opposed this application.

In view of the urgency expressed, this Tribunal directs the Ld. Presiding Officer, DRT-II, Delhi to decide M.A. No.35/2026, in accordance with law, by Friday i.e. 27.03.2026.

File be consigned to record room.
