Ms. Pratiti Rungta, Ld. counsel appeared for respondents through VC

**Misc. Application No.02/2026**

On 13.3.2026, Ld. counsel for the applicant submitted that Hon'ble DRAT, Delhi passed an order on 12.07.2019 on the basis of submissions of the Ld. counsel for respondents 1 to 3, on instruction from respondent no.2 that without prejudice to their legal contentions which remained going for further course of hearing, the respondents are ready to deliver the keys of the mortgaged properties as described in para 7 (c) at Sl. Nos. (i), (ii), (iv) and (v). On that basis, Ld. Chairperson passed an order to respondents to surrender the possession of the properties by delivering the keys thereof in the Registry of this Tribunal within 10 days. Accordingly, keys had been delivered. Now, Ld. counsel for applicant is seeking handover of those keys to the applicant.

Ms. Pratiti Rungta, Ld. counsel for the respondents no.1 to 3 submitted that respondents have no objection to hand over these keys to the applicant.

This Tribunal, on going through the records, found that the Ld. Chairperson, DRAT, Delhi had passed the following order on 12.07.2019 :

" It is clarified that the order for delivery of keys in the Registry of this Tribunal in respect of the mortgaged properties would not be construed as any kind of expression of any opinion by this Tribunal on the rights of any of the parties which they are seeking to urge before this Tribunal as well as before DRT. All questions are left open for the time being. Once keys are deposited, further appropriate orders would be passed as to what is, to be done in respect of those properties."

On 20.08.2019, when finally disposing the Misc. Appeal No.518/2018, the Ld. Chairperson disposed of the appeal, directing the Ld. DRT to dispose of the O.A. finally in accordance with law within three months from the date of communication of that order. It was made clear that while disposing of the O.A., the DRT shall not be influenced by the filing of this appeal and its being disposed of. DRT was at liberty to pass any orders in respect of the mortgaged properties as also regarding the delivery of keys lying in the Registry of this Tribunal. This order makes it clear that the Ld. Chairperson directed the DRT to decide on delivery of keys.

Thus, Therefore, this application, filed by the petitioner before this Forum cannot be entertained.

Therefore, Misc. Application No.02/2026 is dismissed with a direction to the Petitioner to approach DRT for appropriate orders.

File be consigned to record room.
