ORDER

The writ petition is filed challenging the order passed by the third respondent granting patta in favour of the respondents 4 to 6.

2. The learned counsel for the petitioner submits that the impugned order was passed by the 3rd respondent without issuing notice to the petitioner and, hence, the same is liable to be set aside.

3. The learned Additional Government Pleader, who takes notice for the respondents, would submit that, challenging the very same impugned order, the petitioner has already filed an appeal before the 1st respondent. The 1st respondent has also issued notice for enquiry as early as on 22.06.2026 in his proceedings in Na.Ka.A1/2109/2026. It is further submitted that, pursuant to the direction issued by the 1st respondent, the 2nd respondent has already submitted a report to the 1st respondent on 10.06.2026 in his proceedings in Na.Ka.A2/961/2026. Therefore, the learned Additional Government

Pleader submits that the appeal filed by the petitioner will be disposed of in accordance with law, after considering the report submitted by the 2nd respondent.

4. In view of the fact that the petitioner has already availed the alternative remedy of appeal and the proceedings before the 1st respondent are also halfway through, this Court is not inclined to entertain the writ petition. However, the 1st respondent is directed to complete the enquiry initiated by him in Na.Ka.A1/2109/2026 and pass final orders on its own merits and in accordance with law, within a period of six weeks from the date of receipt of a copy of this order, after affording reasonable opportunity to the petitioner and the private respondents.

5. The writ petition is disposed of accordingly. No costs. Consequently, the connected miscellaneous petition is closed. 17.08.2026 NCC : Yes/No Index : Yes/No Internet:Yes skn
