ORDER

The writ petition is filed seeking a direction to the second respondent to conduct an enquiry and cancel Patta No.4597 in respect of the property comprised in Survey No.226/27, measuring an extent of 0.03.50 Ares (8.64 cents), situated at Keelakkavanipatti Village, Shenbagampettai Post, Iraniyur, Sivagangai District, within a stipulated time, by considering the petitioner’s representation dated 24.07.2026.

2. Heard the arguments of Mr.H.Mahamed Hussain, learned counsel for the petitioner and Mr.C.Deepak, learned Additional

Government Pleader appearing for the respondents. Since no adverse order is going to be passed against the sixth respondent, notice to him is dispensed with. By consent, this writ petition is taken up for final disposal at the admission stage itself.

3. According to the petitioner, the patta in respect of the subject property originally stood in the name of his father, Karupaiya, under Patta No.326. It is alleged that the sixth respondent, without having any right over the property, had the patta mutated in the names of his minor children. Hence, the petitioner submitted a representation dated 24.07.2026 seeking cancellation of the patta issued in the names of the minor children of the 6th respondent. Since the said representation has not been considered, the petitioner has approached this Court.

4. The learned Additional Government Pleader appearing for the respondents, on instructions, would submit that the representation of the petitioner dated 24.07.2026 was received by the second respondent and the same is under consideration.

5. In the light of the above submission, without expressing any opinion on the merits of the matter, the second respondent is directed to consider the petitioner’s representation dated 24.07.2026 and pass final orders on its own merits and in accordance with law, after issuing notice to the petitioner, the sixth respondent, the persons in whose names the patta presently stands, and all other interested parties, and after affording them a reasonable opportunity of hearing, within a period of twelve weeks from the date of receipt of a copy of this order.

6. With the above directions, this writ petition stands disposed of. No costs. Consequently, the connected miscellaneous petition is closed. 17.08.2026 NCC : Yes/No Index : Yes/No Internet:Yes skn To
