ORDER

The writ petition is filed challenging the order passed by the fifth respondent in 2019/0103/30/200813TR dated 02.02.2019 issuing patta in the name of Thangavel Nadar.

2. Heard the arguments of Mr.S.Muthuselvan, learned counsel for the petitioner, and Mr.L.Siva, learned Government Advocate (Civil) appearing for the respondents 1 to 6. Since no adverse order is going to be passed against the private respondents, notice to them is dispensed with. By consent, this writ petition is taken up for final disposal at the admission stage itself.

3. The learned counsel for the petitioner vehemently contends that the fifth respondent passed an order dated 02.02.2020, mutating the revenue records in the name of deceased Thangavel Nadar, who died in the year 2006.

4. It is seen from the affidavit that, challenging the impugned order passed by the fifth respondent, the petitioner has already filed an appeal before the appellate authority, namely, the third respondent, and the said proceeding is pending in Na.Ka.No.A5/4096, dated 04.07.2022.

5. Since the petitioner has already filed an appeal challenging the impugned order, he is not entitled to maintain the present writ petition. Hence, this writ petition is dismissed with a direction to the third respondent to dispose of the proceeding in Na.Ka.No.A5/4096, dated 04.07.2022, and pass final orders within a period of twelve weeks from the date of receipt of a copy of this order, after issuing notice to the petitioner, respondents 7 to 15 and other interested parties. No costs. Consequently, connected miscellaneous petitions are closed. 14.08.2026 NCC : Yes/No Index : Yes/No Internet:Yes skn
