ORDER

The writ petition is filed seeking issuance of a Writ of Mandamus forbearing the respondents 1 to 3 to survey and fix the boundaries of the property in Survey No.62/17C, to an extent of 20 cents on the northern side out of the total extent of 40 cents, situated at Muthakkurichi Village, Pattukkottai Taluk, Thanjavur District.

2. Heard the arguments of Mr.P.Balamurugan, learned counsel for the petitioner, Mr.L.Siva, learned Government Advocate (Civil) for the respondents 1 and 2 and Mr.R.Mohamed Riyaz, learned Government Advocate (Crl. Side) for the third respondent. Since no adverse order is going to be passed as against the private respondents, notice to them is dispensed with. By consent, this writ petition is taken up for final disposal at the admission stage itself.

3. The learned counsel for the petitioner submits that the official respondents proposed to survey the property at the instance of the fifth respondent, pursuant to the order passed by this Court in W.P. (MD) No.7476 of 2026. Upon receipt of notice regarding the proposed survey, the petitioner submitted his objection. After considering the said objection, the first respondent passed an order in his proceedings dated 04.08.2026, which was communicated to the petitioner on 12.08.2026.

4. It is further submitted that, as per the said communication, the parties have been relegated to work out their remedy before the Civil Court. In view of the communication dated 04.08.2026, the Counsel for the petitioner also seeks leave of this Court to work out his remedy before the Civil Court.

5. Recording the said submission of the learned counsel for the petitioner, this writ petition stands disposed of, as no further adjudication is necessary, with liberty to the petitioner and the fifth respondent to work out their respective remedies before the competent Civil Court. No costs.
