ORDER

The writ petition is filed seeking a direction to the first respondent to dispose of the petition filed by the petitioner seeking cancellation of patta in respect of the property situated in Survey Nos. 1787/2, 1787/3, 1788/2, 1788/3 and 1790/3B at Komai West Village, Uthamapalayam Taluk.

2. Heard the arguments of Mr.A.K.Manikkam, learned counsel for the petitioner and Mrs.Porkodi Karnan learned Special Government Pleader appearing for the respondents. By consent, this writ petition is taken up for final disposal at the admission stage itself.

3. According to the petitioner, an extent of 13 acres and 92 cents of land comprised in the aforesaid survey numbers originally stood in the name of the petitioner’s great-grandfather, Virumandi Thevar, under Patta No.502. The said Virumandi Thevar had two sons, namely, Paya Thevar and Naga Thevar. The petitioner claims to be the daughter of Naga Thevar. The patta in respect of the subject property presently stands in the name of the brother of Naga Thevar and one Mohammed Ismail. According to the petitioner, the name of Mohammed Ismail has been wrongly included in the patta in respect of the family properties. Therefore, the petitioner submitted a representation before the first respondent seeking cancellation of the patta insofar as it relates to the name of Mohammed Ismail. The first respondent called for a report from the second respondent as early as 14.06.2024, vide proceedings in Na.Ka.No.1037/2024/A3. However, till date, no final order has been passed by the first respondent. Hence, the petitioner has come before this Court.

4. The learned Special Government Pleader, who takes notice for the respondents, would submit that the proceedings pending before the first respondent will be disposed of within the time frame fixed by this Court.

5. In the light of the said submission, the first respondent is directed to complete the proceedings in Na.Ka.No.1037/2024/A3 initiated by him, vide proceedings dated 14.06.2024, and pass final orders on its own merits and in accordance with law, after affording a reasonable opportunity of hearing to the petitioner, the legal heirs of Paya Thevar, the legal heirs of Mohammed Ismail, and other interested parties, within a period of twelve weeks from the date of receipt of a copy of this order.

6. With the above direction, the writ petition stands disposed of. No costs.
