1. 1. The instant application is filed for early hearing of the present appeal bearing No. 264/2026.
2. 2. Sh. Pallav Saxena, Counsel for applicant / appellant stated that the appellant being defendant no.4 in the O.A. bearing No. 667/2016 was never served with the notice of OA and as such when the effective service upon the appellant took place, the OA was allowed vide judgment dated 28.01.2019.
3. 3. Sh. Pallav Saxena, Counsel further stated that he may be allowed to withdraw the present appeal as the appellant is initiating appropriate legal proceedings before the concerned DRT within a week to challenge the order dated 28.01.2019.
4. 4. In view of the submissions made by Sh. Pallav Saxena, the present appeal is allowed to be dismissed as withdrawn along with pending applications, if any.
