1. The respondents filed S.A. bearing no.282/2022 titled as **M/s Alpine Enterprises & another V. Punjab & Sind Bank** which is stated to be pending before DRT-II, Delhi. DRT-II, Delhi vide the impugned order dated 25.10.2022 ordered that the respondent bank not to take any coercive steps. The order dated 25.10.2022 is reproduced as under:- The Ld. counsel for applicant submitted that account was no NPA on 31.03.2021. He pointed out the statement of account in this regard which reflects that the outstanding amount was less than the limit sanctioned with respect to the said accounts. He further pointed out that GECL and FICL accounts were against unsecured loan and said loans cannot become secured liability in any manner.

On the other hand, Ld. counsel for respondent bank submitted that account was declared NPA on 31.03.2021 as during the Covid period no amount paid by the S.A. applicant. However, account was not declared NPA on account of RBI guidelines and was declared NPA only on 31.03.2021. He further submitted that being an NPA account, SA applicant is not entitled for any protection.

I am not satisfied with the contention of Ld. Counsel for respondent bank and the rival submission made by both the side can be verified only after filing of reply alongwith supporting documents by the respondent bank, if any.

Matter be listed on 23.11.2022 before Registrar for completion of pleadings. In the meantime, any coercive steps by respondent bank is hereby stayed.

2. The appellant being aggrieved filed the present appeal. However, keeping in view the fact that the impugned order was passed on 25.10.2022 and S.A. is still pending for consideration, the present appeal is disposed of with the direction to DRT-II, Delhi to dispose of the S.A. No.282/2022 as expeditiously as possible, preferably on or before 31.07.2027. It is made clear that all the pleas and contentions of the contesting parties shall remain open during the trial of the S.A. bearing no.282/2022.
