Order
12.08.2026
Heard Ms. S. Jotibala, learned counsel for the applicant and Mrs. Ch. Sundari, learned G.A. for State respondent.
By the present application, i.e., MC(WP(C) No. 11 of 2026, petitioner prays for review/recall of order dated 18.12.2025 passed by this Court in WP(C) No. 1020 of 2022. On 18.12.2025, when the main writ petition, i.e, WP(C) No. 1020 of 2022 was taken up, Mr. A. Manigun, learned counsel for the petitioner, submitted that the matter became instructuous and recording the submissions made at the bar, on instruction, this Court closed the writ petition as infructuous. In the present application, it is stated in para 3 that due to misinformation given to learned counsel appearing for the parties, the statement of infructuous was made. However, the cause of the writ petition is still survived and in the circumstances, it is submitted that the order dated 18.12.2025 passed by this Court in WP(C) No. 1020 of 2022 be recalled and writ petition be brought on board of this Court for hearing on merit.
Mrs. Ch. Sundari, learned G.A. for the State respondent, does not strongly oppose, however, she has pointed out that the application is not proper and affidavit is sworn by the petitioner.
This Court has considered the materials on record and without going into the technicalities of the matter, the application is allowed. The order dated 18.12.2025 passed by this Court in WP(C) No. 1020 of 2022 is recalled and the main petition is restored for board of this Court.
List the main case on 03.09.2026.
