BEFORE HON'BLE THE CHIEF JUSTICE MR. M. SUNDAR

For petitioner: Mrs. G. Pushpa, Advocate along with Ms. Helly Ch., Advocate

Date of Order: 05.08.2026

(ORDER)

When the matter was taken up Ms. G. Pushpa, learned counsel along with Ms. Helly Ch., learned counsel on record for arbitration petition petitioner was before this Court.

2026:MNHC:155

It came to light that some inadvertent errors have crept in.

Faced with the above situation, learned counsel for arbitration petition petitioner sought leave of this Court to withdraw the captioned arbitration petition but made a plea to preserve all the rights and contentions of the arbitration petition petitioner to file another petition with similar/same prayer on the same issue after making requisite course corrections. To be noted, this course is being adopted as it is less cumbersome compared to filing an amendment application.

A scanned reproduction of the endorsement made by learned counsel on record for arbitration petition petitioner in the case file is as follows:

In the light of the narrative thus far, captioned arbitration petition is disposed of as withdrawn/closed albeit with preservation of rights and contentions of the arbitration petition petitioner in the manner stated above. When the arbitration petition is filed afresh after making course corrections, instant order shall be annexed as an annexure. There shall be no order as to costs.
