ORDER

23.07.2026

Present Ms. Th. Babita, learned counsel for the petitioner on VC along with Ms. Nandita, learned counsel on behalf of the petitioner; Mr. H. Debendra, learned Dy. AG assisted by Ms. I. Sharmila, learned Jr. Govt. counsel on behalf of the State respondents; and Mrs. I. Bimola, learned counsel for the MPSC.

By the present petition, the petitioner prays for determining inter- se-seniority positions of the Executive Engineer in PWD, Manipur on the ground that the Division Bench of Gauhati High Court in order dated 06.05.2026 in W.A. No. 296 of 2025 kept the question of law open while upholding the promotion of the private respondents and petitioner herein, in the cadre of Executive Engineer, thereby upholding the decisions of this Court in order dated 31.07.2024 in WP(C) No. 386 of 2022. Besides, the petitioner also submitted a representation dated 04.06.2026 to consider the seniority list of the Executive Engineer/ Surveyor of Works/ Engineer Officers (Civil) in PWD, Manipur in terms of the decisions of Division Bench of the Gauhati High Court in W.A. No. 296 of 2025.

Ms. Th. Babita, learned counsel for the petitioner submits that the writ petition can be disposed of at this stage by issuing a direction to the respondents to consider and pass a speaking order on the pending representation submitted by the petitioner. When the matter was taken up on 13.07.2026, the Dy. AG sought some time for taking instruction with the limited prayer of the petitioner.

Today, Mr. H. Debendra, learned Dy. AG submits that writ petition may be disposed of at this stage by issuing an innocuous order. Mrs. I. Bimola, learned counsel for the MPSC submits that this Court may pass appropriate order.

This Court perused the materials on record. Since the Division Bench of Gauhati High Court kept the question of seniority in the cadre of Executive Engineer open, the writ petition is disposed of, considering the limited prayer of the petitioner for disposal, by directing the Administrative Department to pass a speaking order to the representation submitted by the petitioner as per law within a period of 2(two) months’ from the date of receipt of copy of this order.

It is made clear that this Court does not express any opinion on the merit of the case. While disposing the writ petition, if the right of the private respondents (who have not been issued notice) is to be affected, they have to be heard at the time of disposal of the representation.

With these observations, WP(C) No. 499 of 2026 is disposed of.
