Cril. Petn. No. 38 of 2026 Contd.../-

The present petition has been filed seeking for the following reliefs:- “(a) Quash the FIR being No. 386(9)2015 IPS and Section 25(1-(b) of the Arms Act, dated 18-09-2015 registered under Sections 16/20 of the Unlawful Activities (Prevention) Act, 1967 and Section 25(1-B) of the Arms Act, 1959 at Annexure A/1; (b) Quash all consequential criminal proceedings arising therefrom;

(c) Pass appropriate order holding that the continued investigation after non-compliance of the earlier order of this Hon’ble Court is illegal; (d) Pass any other order/ orders as this Hon’ble Court may deem fit and proper in the interest of justice.”

It is on record that the present petitioner had already filed a petition before this court registered as Cril. Petn. No. 23 of 2025 seeking therein the same reliefs, which are sought herein, i.e., for quashing the abovementioned FIR. The said earlier Cril. Petn. filed by the present petitioner was dismissed by this court by a judgment and order dated 28-11-2025 as being devoid of merit. The said judgment and order is enclosed herein as Annexure/2 in the present Cril. Petn.

I have carefully perused the said judgment and order and on perusal of the same, this court is satisfied that all the grounds raised by the petitioner in the present petition have been considered and rejected by this court in the earlier judgment and order dated 28-11-2025.

Contd.../-

In view of the above, this court is not inclined to entertain this petition as the same is barred by the principle of res judicata. Accordingly, the present petition is hereby dismissed as not maintainable.
