For the applicant Ms. Phanjoubam Sandyarani Chanu, Advocate For the respondents Mr. Ajoy Pebam, Advocate Date of order 15.06.2026

(O R D E R)

(Mr. M. Sundar, CJ)

Captioned ‘MC’ (‘Miscellaneous Case’) has been taken out with a prayer to make amendments in the main appeal. Though styled as an amendment application, in effect, it is a course correction in an annexure SHAMURAILATPAM SUSHIL SHARMA Digitally signed by SHAMURAILATPAM SUSHIL SHARMA Date: 2026.06.15 21:52:54 +05'30'

filed with the main appeal as one of the annexures filed with the main appeal (impugned judgment) has been filed inadvertently without some pages. This is evident from paragraph 2 of the MC application which reads as follows : ‘2. That due to bonafide mistakes and inadvertence, the appellant has committed certain omissions in 2 (two) of the Annexures and the appellant desire to correct them as follows :-

(i) That the front 2 (two) pages of the Judgment and Order dated 02-03-2019 in Annexure-A/7 be inserted as page No. 52(A) and 52(B) in between page No. 52 and 53.

Copies of the front 2 (two) pages of the Judgment and Order dated 02- 03-2019 are enclosed herewith as Annexure-B/1 (Colly).

(ii) That the Points for Determination dated 18-12- 2024 be inserted in between page No. 78 and 79 as page No. 78(A).

A copy of the Points for Determination dated 18-12-2024 is enclosed herewith as Annexure- B/2.’

In the captioned MC application, Ms. Ms. Phanjoubam Sandyarani Chanu, learned counsel on record for the MC applicant and Mr. Ajoy Pebam, learned counsel on record for all the respondents are before this Court (physical Court).

Learned counsel for MC applicant expresses regret for the error that had occurred while filing the appeal and makes a plea to accede to the prayer in the captioned MC. Mr. Ajoy Pebam very fairly submitted that he is neither filing affidavit-in-opposition nor opposing the prayer in the captioned MC.

This Court, being satisfied that the error is owing to inadvertence, the prayer is innocuous and also noticing that the MC

application is not opposed by the respondents, deems it appropriate to write that prayer in the captioned MC application is acceded to.

Necessary and consequential amendments qua instant order shall be carried out on or before 26.06.2026.

In the result, captioned MC application is allowed/ordered as prayed for. There shall be no order as to costs.
