It has been submitted by the learned senior counsel appearing on behalf of the applicant that the present application has been filed with a prayer for allowing the Examination-in- Chief of the DW No. 3 as first witness on behalf of the applicant/respondent No. 1. The learned senior counsel submitted that the examination of the said DW No. 3 has already been completed and as such, the present application has become infructuous and the same may be closed.
