Present Mr. M. Devananda, learned Addl. A.G. assisted by Mr. Tomclist, learned counsel for the appellant; Mr. L. Atembi, learned counsel for respondent Nos. 1 to 6, who are claimants before the tribunal; Mr. W. Niranjit, learned Dy. G.A. on behalf of respondent No. 7 and Mr. Th. Ibohal, learned senior counsel assisted by Ms. Karishma, learned counsel for respondent No. 8.

Vide judgment and award dated 13.12.2022 passed by the Ld. Motor Accident Claims Tribunal, Lamphelpat in MAC No. 105 of 2022, a sum of Rs. 4,00,000/- (Rupees four lakh) was directed to be paid by respondent Nos. 1 to 3 in the claim case. Respondent No. 1 before the claim tribunal, i.e., State of Manipur through Secretary (GAD), Government of Manipur filed the present appeal, i.e., MACApp. No. 1 of 2025 confining to the plea that since the deceased was an employee of Manipur Fire Service, the direction for payment of compensation by respondent Nos. 1 to 3 before the claim tribunal may not be proper as the deceased was an employee of Manipur Fire Service who was respondent No. 2 before the claim tribunal.

The appeal before this Court was limited for deletion of the name of respondent No. 1, i.e., appellant herein (Secretary, GAD, Government of Manipur) from direction to pay compensation jointly and separately with other respondents.

Vide order dated 13.02.2026, this Court has referred the matter to the mediation for finding an amicable solution with an observation that the deceased was an employee of Manipur Fire Service and not an employee of General Administrative Department (GAD) and Manipur Fire Service is under the Home Department. Before the mediator vide settlement dated 28.04.2026, the matter has been settled on the ground that the claimants have already received a sum of Rs. 9,12,000/- (Rupees nine lakh twelve thousand) and the matter has been agreed to be disposed of accordingly.

During the course of hearing, it is submitted that vide order dated 31.03.2026, the Commissioner (Home), Government of Manipur has sanctioned a sum of Rs. 2,80,000/- (Rupees two lakh eighty thousand) as payment of the remaining balance amount of the compensation.

However, Mr. M. Devananda, learned Addl. A.G., has pointed out that in the mediation settlement dated 28.04.2026, the main prayer of the appellant, i.e., General Administrative Department, Government of Manipur regarding deletion of the name of GAD from the operative part of the award dated 13.12.2022 and the deceased is not an employee of the GAD is not taken care and it is submitted that since the claimants have admitted the receipt of the remaining amount of the claim, this Court may pass appropriate order.

Mr. L. Atembi, learned counsel for the claimants, submits that the claimants have received the balance amount of the award and nothing is due from the State respondent.

Since the claimants have admitted the receipt of the amount under the award along with interest, this Court disposed of the writ appeal by deleting General Administrative Department from the liability to pay the award and with an observation that the deceased employee of the Manipur Fire Service.
