ORDER

(Order of the Court was made by M. Sundar, CJ)

06.11.2025

Read this in conjunction with and in continuation of earlier proceedings made in the previous listings.

Today, Mr. N. Kumarjit, learned senior counsel appearing on behalf of Mr. N. Zequeson, learned counsel on record along with Mr. Rajiv Thokchom highlighted that pages 97, 98, 99, 104 and 105 in the grounds of detention as served on the detenue are not legible/readable.

Mr. Th. Vashum, learned State counsel for R1 to R3 and Mr. S. Vijayanand Sharma, learned Senior Panel Counsel for Central Government (Sr.PCCG) appearing on behalf of Mr. Themchuiyo Kashung, learned counsel on record for R4 are also before us.

The above point has been raised in the affidavit and in response to the same, the detaining authority has averred that the detenue SHAMURAILATPAM SUSHIL SHARMA Digitally signed by SHAMURAILATPAM SUSHIL SHARMA Date: 2025.11.07 14:00:58 +05'30'

has signed in each page of the grounds saying that he understood all the contents.

Learned counsel on record for the petitioner sought a short accommodation to get instructions on the above points and bring the same on board by way of an affidavit by next listing.

To be noted, in representation dated 11.08.2025 to R3 (detaining authority) the detenu has in subparagraph 2 of paragraph 13 categorically averred that certain documents are illegible and not readable. At least 5 (five) documents have been referred to there. These 5 (five) documents are the pages referred to supra.

To be noted, while the service of the detention order on the detenu was on 09.07.2025 at 9:10 p.m. the afore-referred representation has been made on 11.08.2025. It is in this context that instructions from detenue and an affidavit in this regard have become imperative.

List on 18.11.2025.
