in press: JUDGMENT AND ORDER (ORAL)

1. The petitioner who was a Fire Guard in the respondent Institute pursuant to a Departmental Proceeding was terminated from service on 25.02.2026, whereafter, he had preferred a statutory appeal before the Executive Committee/Appellate Authority on 24.03.2026. The grievance of the writ petitioner presently is that in spite of the appeal being preferred since 24.03.2026, the same is yet to be disposed of by the Appellate Authority.

2. Mr. A. Dkhar, learned counsel for the petitioner on these facts, prays that the writ petition be disposed of at this stage, by directing that the appeal be heard and disposed of, within a period of 1(one) month.

3. Dr. N. Mozika, learned DSGI assisted by Ms. C. Jala, learned counsel for the respondents though affidavit is yet to be filed, has produced before this Court the Minutes of the 8th Meeting of the Executive Committee of the respondent No. 1, held on 04.08.2026, whereby at Agenda No. 43/EC-8, with regard to the consideration of the petitioner’s case against the order of removal from service, it has been recorded that the Executive Committee has taken note of the appeal and has submitted the same for consideration by the competent authority, for decision .

4. In the facts and circumstances of the case, and in view of the submissions made by the learned counsel for the petitioner that it would suffice that directions be issued for disposal of the appeal, it is therefore, directed that the competent authority i.e. the Secretary to the Government of India, Ministry of Health & Family Welfare, take up the matter and dispose of the same, within a period of 2(two) months from the date of receipt of a copy of this order.

5. A copy of the Minutes of the 8th Meeting of the Executive Committee produced by the learned DSGI. is taken on board and made part of the record.

6. With the above noted directions, the matter stands closed and is accordingly disposed of.
